§ 10.5-4. Exemptions.

  • The provisions of this chapter shall not be applicable to the following persons while such persons are engaged in the performance of the duties of their respective professions:

    (a)

    Certified massage therapists compliant with section 10.5-3 of this chapter.

    (b)

    A person licensed by the Commonwealth of Virginia as a physician, surgeon, chiropractor, osteopath, occupational therapist, or physical therapist, or their employees, under their direction and supervision.

    (c)

    A nurse licensed by the Commonwealth of Virginia who acts under the direction of any person described in subsection (b) hereof.

    (d)

    Employees of nursing homes, medical clinics, and hospitals duly licensed by the state, provided the employees are engaged in the personal performance of their employment and are acting under the direction and supervision of a licensed health care professional.

    (e)

    Licensed trainers of any amateur, semi-professional, or professional athlete or athletic team as well as licensed athletic trainers employed by a fitness studio/center as defined in section 10.5-1 of this Code engaged in the personal performance of their employment.

    (f)

    A person who is employed in or who operates a barbershop or beauty parlor, only when such establishment is licensed as such by the county, and only for the purposes of massage of the scalp, face, neck, or shoulders while on such premises during normal business hours.

    (g)

    A student of an approved school as defined by section 10.5-1 of this Code, provided the student is identified as a student and is acting under the direction and supervision of a certified massage therapist at all times while providing services to client.
