§ 20-14. Violations and penalties; injunctive relief.

  • Any person who knowingly, intentionally, negligently or continually violates any provision of this chapter or any provision of a permit granted by the wetlands board shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than two thousand five hundred dollars ($2,500.00); or by a term of jail of not more than one (1) year; or both. Following a conviction, every day the violation continues shall be deemed a separate offense.

    Upon the petition of the commission or a wetlands board to the Circuit Court of Gloucester County where any act is done or threatened which is unlawful under this chapter, the court may enjoin the unlawful act and order the defendant to take any steps necessary to restore, protect, and preserve the wetlands involved. This remedy shall be exclusive of and in addition to any criminal penalty which may be imposed under section 28.2-1318 of the Code of Virginia.
