§ 4-2. Maintenance and operation.

  • (a)

    Fences. There shall be erected and maintained around all automobile graveyards and junkyards which have any portion thereof within one thousand (1,000) feet of the right-of-way of any highway comprising a part of the state highway system fencing, natural objects or plantings so the automobile graveyard or junkyard will not be visible from the main-traveled way of the highway.

    (b)

    Exemption from fence requirement. Automobile graveyards and junkyards which are in area 1 zoned for industrial use under authority of the board of supervisors are exempt from the requirements of subsection (a) of this section.

    (c)

    Advertisement on fences. The fence enclosing an automobile graveyard/junkyard shall not be used for bill postings or other advertising purposes, except that a space not larger than six (6) feet by twelve (12) feet may be used for the advertisement of the business of the owner thereof. Where such yard fronts on more than one street, the use of space for advertisement herein permitted shall extend to each street on which the yard abuts.

    (d)

    Contents not to extend above height of fences. The contents of an automobile graveyard/junkyard shall not be placed or deposited to a height greater than the height of the fence surrounding it.

    (e)

    Time for demolishing and wrecking cars. Work in connection with the demolishing or wrecking of cars shall be permitted only on weekdays between the hours of 7:00 a.m. and 6:00 p.m.

    (f)

    Open fire. No open fire for the burning of rubbish, trash, automobiles, or any parts thereof, or other waste matters, shall be permitted.

    (g)

    Rubbish and waste matter. An automobile graveyard/junkyard shall, as far as practicable, be kept clear and clean of all rubbish or waste matter.

    (h)

    Gasoline to be drained from vehicles. All tanks and engines shall be kept thoroughly drained of gasoline.

    (i)

    Sheriff's deputies to have access for inspection. All automobile graveyards/junkyards, together with the books required by this article shall be at all times open for inspection to all officers of the county having police power, the zoning official, and the building inspector.

    (j)

    Time when purchases by operator permitted. No purchaser operating or maintaining an automobile graveyard/junkyard shall purchase any vehicles, or parts or accessories thereof, except between the hours of sunrise and 7:00 p.m.

    (k)

    Records. Any person maintaining or operating an automobile graveyard/junkyard shall keep at his place of business a book in which a record shall be kept of the day and time of day of each purchase, the name, residence, and description of the person selling and actually delivering the vehicle, parts, or accessories purchased, the amount of the purchase price, the make, state license number, motor number, body number, style, seating capacity of the vehicle purchased; the make and identifying number of the radiator, speedometer, and magnetos purchased, together with any other information concerning said property as may be necessary to provide ownership or identity of such vehicles or of such automobile parts or accessories purchased.

    (l)

    Buying, selling, etc., vehicles or parts from which identification marks have been removed; notice to police. No purchaser shall knowingly buy, sell, receive, dispose of, conceal or have in his possession any motor vehicle, part or accessory from which the manufacturer's serial number or any other number or identification mark has been removed, defaced, covered, altered or destroyed for the purpose of concealing or misrepresenting the identity of the vehicle, part or accessory. Every person to whom is offered for sale any motor vehicle, part, or accessory from which has been removed, defaced, covered, altered or destroyed the manufacturer's serial number or any number or identification mark shall immediately notify the sheriff.

    (m)

    Sales to minors. No licensee under this chapter shall purchase any auto or auto part of any article whatever from any minor without the written consent of the minor's parent or guardian.

    (n)

    Investigation of premises. The building inspector or other county official, on routine inspection or upon request of a complaint may investigate a suspected automobile graveyard/junkyard operation and record the make, model, style, and identification numbers of all suspected junk motor vehicles.

    (o)

    Permit required. No person shall maintain or operate an automobile graveyard or junkyard, as defined in this chapter, without having first obtained a permit therefor from the board of supervisors.

    Application for a permit shall be made to the county administrator and shall contain the name and address of the applicant and the location of the premises where the business is to be carried on. A fee of twenty-five dollars ($25.00) shall be charged. Such permit shall only be granted after a hearing shall have been conducted by the board of supervisors. All applicants must agree in writing to the requirements of the county ordinances and such other reasonable regulations as may be imposed by the board of supervisors.

    (p)

    Penalty. Any person violating any provision of this section shall be guilty of a Class 1 misdemeanor, and a separate offense shall be deemed to be committed on each day during or on which a violation shall continue.
