§ 5.5-14. Exceptions.

  • Exceptions to the requirements of section 5.5-7(b) and 5.5-9(c) of this chapter may be granted by the Chesapeake Bay Preservation and Erosion Commission provided that: 1) exceptions to the requirements shall be the minimum necessary to afford relief; 2) reasonable and appropriate conditions are imposed, as warranted, that will prevent the allowed activity from causing a degradation of water quality; 3) granting the exception will not confer upon the applicant any special privileges that are denied this chapter to other property owners who are subject to its provisions and who are similarly situated; 4) the exception is in harmony with the purpose and intent of this chapter and is not of substantial detriment to water quality; 5) the exception is not based upon conditions or circumstances that are self-created or self-imposed; and 6) other findings, as appropriate and required by the county.
